EB-2和EB-3簡介
EB-2高學歷專業人士,一般是指碩士或博士,或相當於高等學歷者(學士加五年工作經驗)。高等學歷是指具有美國碩士以上學位或外國同等學歷。
學士學位加上在此專業領域的五年工作經驗,將視為等同於碩士學位。5年工作經驗,可以在美國境內或境外累積計算。但如果要這樣計算的話,一定要在獲得學士學位後獲得的經驗。另外如果雇主要求該職位需要碩士學位,則不能用學士學位加五年工作經驗代替。
EB-3專業人士(Professionals with Bachelor's Degree),即擁有美國大學或外國大學所頒發的學士學位的專業人士。必須經過美國的學曆認證,確保達到美國大學學曆標準。與H-1B可以用工作經驗代替學曆的不同之處在于,移民局對此類移民有特殊限制,即外籍人士不可以工作經曆來替代相應的大學本科學曆。EB-3A常見的職位包括:建築師(Architects)、工程師(Engineers)、律師(Lawyers/Attorneys)、內外科醫生(Physicians/Surgeons)、教師(Teachers)等。
EB-3技術人員(Skilled Workers),即在能夠勝任要求有兩年以上的專業技能培訓或工作經驗的工人。從事的工作既不是專業性工作,也無需取得學位,但該工作要求受益人擁有至少2年的培訓或工作經驗。在有些工作領域,技術工人比需要有學士學位的專業人士更容易申請辦理,如在餐飲業,需要2年工作經驗的中國廚師更能證明美國缺乏會做中餐的廚師,比較容易地取得永久居民身份。此外,專業護士、物理理療工作者等均系美國勞工市場短缺的技術人員。EB-3B常見的職位包括:法律助理(Paralegals)、注冊護士(Registered Nurses)、教職助理(Teaching Assistants)、船舶裝配/焊接工(Ship Fitters/Marine Welders)、司機(Divers)、廚師(Chefs/Butlers)等。
EB-3非技術人員(Unskilled/Other Workers),即能夠勝任此項工作,但工作經驗或受訓不滿兩年的外籍人士。值得注意的是,即使該外籍人士有兩年工作經驗或受訓兩年以上,如果招聘職位並沒有兩年以上的工作的要求,該外籍人士也屬于非技術勞工。因此,雇主的勞工證申請中對該工作的最低要求是決定該工作屬於第三優先中的哪一個類別的關鍵,技術人員和非技術勞工的區分界限很重要。非技術人員的配額只有1萬個名額,而且不能從其他配額接收未用完的名額,所以要等待排期的時間一般都很長。常見的EB-3C職位包括:食品加工廠工人、大樓清掃工、道路清潔工、洗衣工、食品加工工人、餐廳服務員、廚房幫工等。
PERM介紹
一、PERM的概念
PERM是“Program Electronic Review Management System”(勞工證電子申請管理系統),的縮寫稱謂,於2005年3月28日生效。簡單來說,PERM法案是允許雇主在網上提交勞工認證申請的一種新的勞工認證機制。雇主不需要提交與案件有關的證據性文件,但必須要準備和存放所有的相關資料以供勞工部查詢。並且要準備一系列廣告以及面試流程,時間耗費較長,並且費用花費高。
二、普遍工資
申請勞工證之前,雇主需要向勞工部申請普遍工資。普遍工資是美國勞工部(DOL )根據勞工市場訊息在某一時間段,某一地區,某一職位所得出的普遍工資標準,根據等級不同。分為四級工資標準。
三、雇主招聘
為了防止雇主雇傭廉價外籍員工,降低美國勞工的就業機會,在勞工證的申請過程中,雇主必須證明沒有適合,有意願的美國勞工來擔任所欲申請的職位,因此勞工部要求雇主進行一系列複雜的招聘活動。
  1. 公司內部招聘廣告:雇主必須連續10個工作日在公司內部張貼包括工資及工作內容的告示。
  2. 工作單(Job Order): 在州政府刊登30天的工作單(Job Order).
  3. 兩個星期天的報紙廣告;如果工作要求經驗及碩士以上學歷的話,可以是一個星期天的報紙廣告加上一個專業雜誌廣告.
  4. 對於需要有大學或以上學位要求的職位,雇主除了上述的征人活動外,還必須在以下十種征人活動中任取三種征人方式:例如
    1. 參加人才招聘會
    2. 在雇主網站刊登招聘廣告
    3. 在其他征人網站刊登征人廣告
    4. 校園招聘
    5. 通過貿易或職業公會招聘
    6. 通過職業介紹所或獵頭公司招聘
    7. 員工推薦計畫
    8. 在學校就業輔導辦公室征人
    9. 地區或少數族裔的報紙刊登征人廣告
    10. 廣播或電視廣告征人
  5. 面試流程
  6. 雇主必須對所有條件符合的候選人安排正式的面試,並且對面試者情形作詳細的記錄,統計收到的簡歷數、面試的人數以及拒絕人員、理由;最後對整個面試流程做出總結,證明確實在美國當地尋找不到合適的勞工。
    如果雇主或者律師不能找出拒絕當地員工的理由,就需要雇用該符合條件的美國員工。整個面試流程耗費雇主很多人力以及精力。
兒童身份保護法案(Child Status Protection Act CSPA)
2002年8月6日,美國總統布希簽署了兒童身份保護法案(Child Status Protection Act,CSPA)。該法案的出臺大大減少了申請人的隨行子女因為面談時已經超過21歲而失去移民資格的情況。
根據兒童身份保護法案,在職業移民中,隨行子女的年齡被凍結在配額排到的當月一號,減去當初申請勞工證或I-140(若無需勞工證的話)到I-140批准的審理時間,計算出的年齡在21歲以下,是適用CSPA的首要條件。
另外,要適用CSPA還必須滿足:
1 ) 在配額排到後及時提出移民簽證申請,一般以DS-230第一部分遞交的時間為准。
2 ) CSPA的運用是要申請人主動提出申請的,需要寫一封申請信,並附上相關的證明文件。
符合CSPA的規定,面談時超過21歲也可以隨同全家一起移民美國。
在此需要特別提醒的是:即使你的個案適用CSPA法案,如果不自行提出申請,移民局不會自動對兒童的年齡做凍結或扣減操作,所以申請人的子女如果適用CSPA,就應該採取積極的措施,以免錯失子女隨同全家移民的時機。
優先日期與配額排期
《移民和國籍法》對親屬移民和職業移民設立名額限制。職業移民的名額限制是每年14萬名。正是由於美國對每個國家簽證名額設限,才導致了一些移民大國,像中國,印度,菲律賓的簽證申請人必須排隊好幾年甚至十幾年才能等到配額。
對於那些正在等待名額來申請綠卡的外籍人士來說,配額排期表顯得尤為重要。根據國務院每月公佈的配額排期表,外籍人士可以掌握自己申請案件的進展而及時採取行動。
美國國務院簽證辦公室每月公佈一次各類移民配額排期進度。在配額排期表上,列出了當月已經排到的優先日期的號碼(immigrant numbers),以便領事官員,移民律師和其他移民人士知道某類移民的簽證是否立即就可以拿到了。
配額排期表簡要地說明了各類親屬優先和職業優先移民簽證是否存在名額,還個別地列出了那些申請人數已經超過了可用配額的國家。
如果某類移民現有名額(Current),說明領事館可以立即發放簽證,在配額排期表裏相應的地方用“C” 來標明; 如果某類移民已經超用配額(oversubscribed),配額排期表裏相應的地方會標明一個日期,例如22APR01(2001年4月22日)。 若申請人的優先日期(priority date)在這個日期之前,則可以開始安排領事館面談或申請調整身份;若申請人的優先日期在這個日期之後,則必須繼續等待配額。
優先日期(priority date),即排期,是移民局服務中心或地區辦公室收到移民申請的時間,例如外籍親屬的I-130申請,外籍勞工的I-140申請。如果移民申請必須事先申請勞工證,優先日期則是勞工證申請遞交的時間。在每月公佈的配額排期表中,您會發現優先日期並不是每次都會相應地前進一個月,這主要取決於您遞交申請時那段時間申請人數的多少。若當時申請人數較多,優先日期每月只會前進一個星期;若當時申請人數大幅跌落,優先日期可能每次會前進2個月。當然,有時候會保持不變,有時候也會出現大倒退。

勞工部(DOL)最新規定——替代勞工證 被取消
美國勞工部(DOL)於2007年5月17日公佈了取消替代勞工證(Labor Certification Substitution)(俗稱"轉名")的最終規定,要求勞工證在獲得批准的180天內向移民局申請I-140;從6月17日開始,所有的轉名申請一概不被接受。
"替代勞工證"政策原本是為了方便美國雇主而設的一項便利措施,因為在辦理職業應聘移民過程中,受配額所限,一般需要等待較長的時間,尤其是非技術勞工,目前需要等6年之久。在這數年中,申請人有很多變數,因種種原因,部分申請人最終不能去美國工作,因此,就產生了替代勞工證(轉名)。
然而,這項便利措施在非技術性移民專案的發展、壯大過程中卻被某些不法移民公司或律師濫用為生財的工具,在申請勞工證書的過程中虛報外籍工人資料、公開炒賣勞工證,嚴重損害了雇主的聲譽及申請人的利益,導致移民行業的不規範及管理混亂。為了打擊、限制、杜絕了炒賣此類不法行為,從根本上保障雇主、申請人的利益,勞工部最終決定終止該政策。
根據勞工部的這項新政策,
1) 2007年7月16日之後,將不再接受任何勞工證替換或更改受益人的申請。
2) 7月16日之前批准或正在等待審理的替代勞工證申請不會受到影響

Business Intelligence Analyst
Responsibilities:
• Participate in Business analysis activities to gather required reporting and dashboard requirements.

• Provide server side development to help build a manufacturing web
• Research, evaluate, and deploy new tools, frameworks and patterns to build Telematics Data analytics
• Design, develop, and implement Hadoop/Spark based big data solutions.
• Be an active hands-on team member, collaborating with other developers and architects in developing client solutions.
Qualifications:
• BA/BS degree or equivalent experience.
• A minimum of 2 years of experience building services using back end technologies.
• Understanding of SQL and data warehousing concepts.
• Understanding of leading NoSQL solutions such as Cassandra or MongoDB.
